Canada's newly elected Liberals may legalize marijuana. That could impact US drug policy

With the Liberal Party's electoral victory in Canada, the US's northern neighbors could soon undertake an enormous change in drug policy: marijuana legalization.

The policy was a big part of the Liberals' campaign: "We will legalize, regulate, and restrict access to marijuana. Canada's current system of marijuana prohibition does not work. It does not prevent young people from using marijuana and too many Canadians end up with criminal records for possessing small amounts of the drug."

Heavy trading in Canadian marijuana stocks upon Liberal victory

Shares in publicly traded marijuana suppliers surged in early trading Tuesday, with a Liberal election victory potentially vastly increasing the size of the market that is up for grabs.

During his election campaign, prime-minister-designate Justin Trudeau made it clear that, if elected, one of his early objectives would be the legalization of marijuana – as long as the drug doesn’t end up in the hands of minors.

In campaign literature, the Liberals vowed to design “a new system of strict marijuana sales and distribution, with appropriate federal and provincial excise taxes applied.”

Currently, Canadians can only gain legal access to marijuana for medicinal purposes from licensed suppliers in limited circumstances.

Storefront pot shops still uncertain even with Liberals’ legalization push

One of the incoming Liberal government’s more high-profile campaign planks is its plan to legalize recreational marijuana use, which raises the spectre that Vancouver’s ubiquitous – and, at least for now, illegal – pot shops could soon bloom across the country.

But long-time MP and recent Liberal health critic Hedy Fry said any move to allow storefront sales of cannabis – whether at retail shops or pharmacies, or both – would need approval from an upcoming task force comprising municipal, provincial and federal politicians, law enforcement, and public health and addiction experts.

Changes to marijuana laws could affect people currently facing possession charges

Last night's election guaranteed Canada a change in government.

But more than just different faces, Canadians can expect a change in philosophy from Ottawa.

One area that could see substantive change is marijuana laws.

On the campaign trail, Trudeau promised he'd get working on legalizing pot right away; however, it's unclear what rate it will be taxed at, how it would be controlled and when it would kick in.

Once it does, It could have a profound effect on people currently facing marijuana possession charges.

Criminal defense lawyer Greg Brodsky said punishment is based on the law at the time of sentencing, not what the law at the time of the crime.

"My advice to everyone is hold your breath, and postpone your case," said Brodsky.
