Nevada's Countdown to Legal Pot: Who Is Allowed to Sell Pot?

The Elko Daily Free Press is counting down the days until marijuana is legal in Nevada by answering questions concerning the law.

Q: Who is allowed to sell marijuana starting Jan. 1?

A: While people who are 21 and older will be able to legally possess an ounce or less of marijuana starting Jan. 1, don’t expect any places to legally sell it at the beginning of the year.

The Department of Taxation has 12 months from Jan. 1, 2017, to be ready to receive applications for marijuana establishments. Once the Department begins receiving those applications, it will only accept them from places holding medical marijuana establishment certificates for the first 18 months.

After that other people will be able to apply.

A Nevada lawmaker is working on a plan to make retail marijuana available to adults 21 and over long before the recreational cannabis industry launches in the summer of 2018.

Although marijuana is about to enter into legal status all across the Silver State at the first of the year, people are still going to be forced to lean on the black market for smoke because the cannabis trade is not expected to be ready for at least another year.

It is for this reason that State Senator Tick Segerblom would like to see the state pass legislation that would allow recreational reefer to be sold temporarily through the medical sector – a concept that was successfully implemented last year in the state of Oregon.

Pot Farming Becoming a Big Business

Duke Rodriguez brought a three-week-old pot plant to the State Fair, touching off a silly kerfuffle that highlights the absurdity of our current marijuana laws.

Rodriguez is president and CEO of Ultra Health LLC, based in Scottsdale, Ariz. The plant he displayed to fairgoers is just one of 450 Ultra Health is permitted to grow on its 11-acre pot ranch in Bernalillo.

For publicly exhibiting a marijuana plant, the state demands Ultra Health suspend sales for five days, a penalty Rodriguez says will cost him $100,000.

There’s serious money in the legal marijuana trade, and a lot more still on the horizon.

Despite the state’s voters supporting the initiative to legalize recreational marijuana use on November 8th, licensees are advised to steer clear of permitting it on their premises or engaging with any legal marijuana businesses, as long as federal and state laws are at odds on the matter.
