Should Portland Create a Marijuana Retail Zone?

Portland Commissioner Dan Saltzman has proposed a measure that would limit regulation on newly functioning recreational marijuana facilities by creating a “marijuana retail zone” in the city’s downtown area. Members of the community sounded off to GoLocal about the idea of a “green-light district.”

Saltzman said he wants to eliminate a rule that forbids two marijuana businesses from operating within 1,000 feet of one another in Portland’s central city, which includes downtown Portland and the Lloyd District. Marijuana businesses and dispensaries would still be required to be at least 1,000 feet away from a school.

Ethical considerations when advising a business regarding marijuana-related actives

In the prior installment in this series, we discussed the ethical considerations triggered by a lawyer personally using marijuana. To summarize, the ethical prohibition regarding criminal conduct by the attorney only applies to crimes that reflect on the lawyer’s honesty, trustworthiness, or fitness to practiced law (so-called “crimes of moral turpitude”). Our conclusion was that a lawyer using marijuana, without more, does not create an ethical problem under Rule 8.4(b), as long as the attorney is not under the influence while practicing.

Finding a Place for Cannabis Cash

Anthony Rivera wants Indian tribes to serve the $3 billion trade.

Shaun Gindi brought a duffel bag stuffed with a thousand $20 bills to open a checking account at his local Chase branch. The bank closed his account after a week. As the owner of two marijuana shops and a weed warehouse in Colorado, where the drug is legal, Gindi is a pariah to banks, which face expensive compliance hurdles and uncertain legal consequences because the marijuana business still violates federal law. Of the more than 7,600 banks and credit unions in the U.S., only about 220 accept cannabis cash, according to the Department of the Treasury. “I’ve gone through at least eight banks,” Gindi says.
