Marijuana advocates challenge Clearlake cultivation ban

Marijuana advocates have launched a legal challenge to Clearlake’s ban on cannabis cultivation.

“The Clearlake ordinance is not only extremely cruel, but it is also illegal under California law,” which legalized pot for medical use, attorney Joe Elford said.

The lawsuit is backed by Cal NORML — National Organization for the Reform of Marijuana Laws. Elford said he filed the suit Thursday afternoon on behalf of all the city’s medical marijuana patients.

Watch: Attorney discusses why he's representing those with marijuana convictions for free

HARTFORD - A state supreme court ruling is opening the door for those with marijuana possession convictions to have their records cleared.

Now a Hartford lawyer will help those with convictions free of charge.

Attorney Corey Brinson said there are likely thousands of people in Connecticut with convictions for possession of a small amount of pot, and many probably have no clue they’re eligible to have it expunged.

“We all make mistakes and unfortunately for some people who make mistakes, they are forever tarred and feathered and branded with a criminal conviction,” said Brinson on Thursday.

On Monday the Connecticut Supreme Court ruled unanimously that convictions prior to the 2011 decriminalization of marijuana could be overturned.

Canada: Medical marijuana law goes to Supreme Court

Canada’s high court on Friday will contemplate whether it’s a constitutional right to munch cookies, brownies and oils laced with medical marijuana.

Federal regulations restrict authorized users of physician-prescribed cannabis to consuming only dried marijuana plants. Brewing pot in tea, baking it into a brownie or any form of consumption other than smoking the dried plant buds can trigger criminal trafficking and narcotics possession charges under the Controlled Drugs and Substances Act.

The question before the Supreme Court of Canada, in its first foray into the medical marijuana debate, is whether the Health Canada regulation violated medical marijuana users’ constitutional right to life, liberty and safety.

The Illinois Department of Agriculture must turn over some of the applications it considered during the time it awarded medical marijuana growing licenses to various bidders, two courts ruled Thursday. The decisions centers on a lawsuit filed in February claiming state regulators may have mishandled the process of granting licenses and have kept the process secret. Turning over some of the applications would give lawyers a chance to review the process, according to the Chicago Tribune.

Kevin Sabet has become synonymous with the opposition to  marijuana legalization in the US. As a former drug policy adviser to the White House and co-founder, with Patrick Kennedy, of Smart Approaches to Marijuana (SAM), Sabet has long acted as a major counterpoint to pro-legalization groups like the Marijuana Policy Project and Drug Policy Alliance.
