Outlaw marijuana 'monopolies,' lawmakers say

COLUMBUS – Ohio lawmakers want to eliminate "monopolies" in the Ohio constitution, such as one proposed by marijuana legalization group ResponsibleOhio.

A proposed constitutional amendment unveiled Tuesday would prohibit businesses from creating monopolies in the constitution. That would likely include putting specific parcels of land into the constitution, such as the location of marijuana farms. The change would not affect casino or racino locations already added into the constitution.

"The day of trying to buy our state constitution, we need to start putting some brakes to it pretty quick," said Ohio Speaker Cliff Rosenberger, R-Clarksville.

Marijuana Zoning in Oregon: All Over the Board

We regularly get calls from clients in Oregon who are trying to figure out whether the property they’ve selected for their recreational marijuana business complies with applicable zoning regulations. Unfortunately, it is not yet clear what zoning regulations pertaining to recreational marijuana businesses will look like, because much of this regulation is left to individual cities and counties. Aside from designating sensitive uses such as schools, parks and transit centers, and then mandating a buffer zone (likely 1,000 feet) for marijuana businesses, the state of Oregon does not tend to involve itself extensively in zoning regulations.

South Dakota Indian Reservation Legalizes Marijuana

FLANDREAU, SD - The Flandreau Santee Sioux Indian Reservation has legalized the sale and use of marijuana on tribal land.

Last Thursday, the Flandreau Santee Sioux Tribe Executive Committee became the first reservation in the state to legalize marijuana.

Plans call for one facility where marijuana will be grown, and another place to buy and use the drug for medicinal and recreational use for those over 21.

Those under 21 could use medical marijuana with a doctor's recommendation. It's a controversial issue for the reservation, and the community of Flandreau.

Tribal President Anthony Reider says The Flandreau Santee Sioux Indian tribe is used to stepping forward and taking a stance on controversial issues.

Marijuana shops coming to Santa Monica, but when?

In a week, City Council will have a chance to adopt the massive Zoning Ordinance update, which includes standards for the allowance of two medical marijuana dispensaries.

But when, and where, are the dispensaries going to pop up?

If council adopts the ordinance at its next meeting on June 23, operators could apply for conditional use permits 30 days later. It’s unclear, at this time, how City Hall plans to deal with more than two applications, should they be submitted. Often, lottery systems when City Hall is giving out a limited number of popular permits but the Zoning Ordinance does mention a lottery.

Given the prevalence of dispensaries in the city of Los Angeles, it’s likely that the two permits will be highly sought after.

Jazz festival threatened with massive fine over pot shop ads

One of Vancouver’s most prestigious annual cultural events has been warned it could face millions of dollars in fines for putting marijuana dispensary advertisements in its program guide.

Health Canada told Vancouver International Jazz Festival organizers to stop distributing the guide immediately, or face a maximum fine of $5 million and up to two years in prison.

“Health Canada does not authorize the operation of retail [marijuana] storefronts. These organizations are illegal. Marijuana advertising is illegal,” spokesman Sean Upton said in an email statement.
