When marijuana was officially legalized in Canada on October 17th, 2018, an entire new legal code also came into effect. Under the Cannabis Act, landlords had 90 days to send tenants notice of a marijuana-smoking ban. Just weeks after legalization, we already noticed some frustrated Montrealers being notified of smoking-bans by their condo management.
Many Montrealers scratched their heads and wondered, "if I own my condo, how is it possible that my building can tell me where I can and can't smoke weed?"
When you buy a condo, you agree to abide by the rules of the condominium building, and if the condo complex is banning weed-smoking, you must follow the rules — or break them at your own risk.
That said, the 90-days is almost up, which means that landlords will be sending out their last-minute smoking bans to tenants. The deadline is officially January 15th, 2019.
These smoking bans may only be challenged by tenants only for medical reasons, and you must do so within 30 days of receiving the notice.
It's also important to note that if and when your lease is renewed at any point, your landlord has the right to update it by adding a smoking-ban rule.
Although the idea of not being able to smoke in your own home rubs a lot of people the wrong way, the good news is, you can still smoke outside.
As you may have noticed over the past weeks, people are smoking freely in public places around the city.
Marijuana smoking in public is 100% legal in Montreal — at least, for now. Basically anywhere you can smoke a cigarette, you can light up a joint. Though the current CAQ provincial government has promised to ban public consumption.
