Homegrown bud: Provinces and municipalities decide on limits of legalization

This week, the Resort Municipality of Whistler announced a new bylaw allowing its residents to grow cannabis at home once legalization takes effect on October 17. But home cultivation is still a contentious issue  — especially for landlords and stratas. Current federal legislation for growing at home allows up to four plants per household, and technically, cities do not need to make any new legislation to allow it.

But provinces and municipalities do have the power to restrict how recreational marijuana is grown and sold in their area.

Ontario government will turn to private retailers to sell marijuana

The Ontario government is turning to private retailers to sell marijuana in stores come October, shifting policy dramatically less than three months before Canada legalizes recreational use.

Provincial Finance Minister Vic Fedeli and Attorney-General Caroline Mulroney are expected to make an announcement as early as next week outlining in broad strokes the province’s plan to scrap the existing public retail model and allow the private sector to own and operate bricks-and-mortar cannabis shops, according to a senior source in the Ontario government who would only speak on condition of not being named. The person added that the government will still control the wholesale and distribution of the product to the stores and manage online sales.

BC missing big opportunity in ‘Craft Cannabis,’ say critics.

British Columbia craft cannabis growers fear that federal and municipal regulations will damage the sector, reduce choice and kill a significant economic opportunity.

The well-established but unregulated sector faces new challenges as marijuana is legalized.

Craft growers aren’t even allowed to apply for the right to sell pot to legal outlets until mid-October, while large commercial producers have already signed supply contracts.

The growers are also dealing with new restrictions on agricultural land use and underdeveloped — or hostile — municipal zoning regulations.

Concern growing over unregulated edible cannabis products

Edible cannabis products aren't legal in Canada, but they are being bought, sold and consumed regardless.

A recent case in Nova Scotia has health experts warning about the possible risks for children.

Chris Henderson, the owner of the Cannabis Vape Shop, says it’s important to read the labels.

“They do have a good amount of information on them, but you want to know it's accurate,” Henderson said.

Some bags of cannabis edibles look like they contain candy, and because they exist in an illegal market, there aren't any rules in place for controlling how they're made, and how they're packaged.

Health Canada warns cannabis companies against advertising at music festivals and other events

As the country moves closer to legalization, Health Canada is warning cannabis companies currently sponsoring music festivals and other events that they need to comply with advertising regulations or they could risk serious consequences.

Promoting cannabis brands is being viewed similarly to the way tobacco is promoted, which is essentially not at all. Cannabis companies are therefore rushing to promote their brand ahead of legalization.

The law will not take effect until October 17, the official date set for nationwide legalization.

Companies who do not comply with the law risk having their licensed suspended, fines as high as $5 million and possible jail time, said Health Canada in a public notice.
